事情是这样的，我一亲人出车祸后颅内大出血，手术后没有任何救治过来的希望。现已脑死亡，依靠呼吸机药水等来维持心跳，病人一直住在医院ICU，每天的费用需要。交警队虽然对肇事方下过多次医药费垫付通知，但是对方态度很不好，仅仅拿出2000块说我没钱就是准备坐牢的。我们这边条件也很差，撑了差不多半个月了资金也有特别大的压力了。但是我们也不能直接把人带回去！医生前天找到我们，说如果我们愿意器官捐赠他们就可以停止药水开具是因脑颅撞击导致的死亡证明然后进行器官捐赠。但是我们咨询律师，他告诉我们死亡后会有法医鉴定，如果法医发展身上有捐赠器官的手术刀口，会描述到鉴定书内，将来肇事方会将死亡责任推脱到我们身上。所以我请咨询了解相关情况的知友帮忙建议律师所讲的有没有道理并且器官捐赠后，在将来的司法程序上会对我们有什么不利的情况，万分感谢
脑死亡不是死亡，不是人生命的终结。人死之后告知交警队是否需要作尸体解剖以查清死因，法医会作出判断，医生在法律没有这个资格。
